Terms of Usage

1. Acceptance of Terms

By accessing or using Genwealth 8 ("the Service"), you agree to comply with and be bound by these Terms of Usage. If you do not agree to these terms, please do not use the Service.

As used in this Terms:

user” means an individual who has entered into a contract with us for the supply of any goods or services by us via the usage of the Service.

We may make changes to these Terms of Usage from time to time, and we may notify you of such changes by any reasonable means. Your continued usage of the Service following changes to these Terms of Usage will constitute your acceptance of those changes.

 

2. Safe Environment Practice

For the duration of the Service usage and interactions among all users, users agree not to directly or indirectly solicit, poach, recruit, or hire other users [Financial Adviser Representative/Financial Consultant (FC)/Agency Leaders] to join their agency. We reserve the right to activate Termination referenced in clause 15 without refund and permanently ban the user if there is a breach of this clause.

 

3. Description of Service

Genwealth 8 provides individuals and corporations access to a variety of software modules, including but not limited to digital documents and digital resources. The Service may include updates, new features, or enhancements, which are subject to these terms.

 

4. Software and Subscription

You confirm that you are a Financial Adviser Representative/Financial Consultant (FC) and possess the full capacity and competence to agree to the terms, conditions, obligations, affirmations, representations, and warranties outlined in these Terms of Usage. Furthermore, you commit to observing and complying with these Terms of Usage.

The software is offered through subscription plans, open to both individuals and corporations. Each person utilizing the software must acquire and sustain an active subscription, either personally or through their corporate entity. Subscriptions are non-transferable and cannot be sold under any circumstances. Unauthorized provision of access to third parties, whether directly or indirectly, without our explicit written consent will be deemed a violation of these terms.

Upon subscription to the software, you are granted access for the duration of your paid term. Even if you choose to cancel, your access will persist until the conclusion of your subscription period.

 

5. User Accounts

Users must provide accurate and complete registration information.

Users are responsible for maintaining the confidentiality of their account information and passwords.

Users are responsible for all activities and access to the Service that occur under their account, even if the access is by another person.

 

6. Use of the Service

Users may only use the Service for lawful purposes.

Users shall not engage in any activity that disrupts or interferes with the functionality of the Service.

 

7. Service Access

We will make reasonable efforts to maintain the continuous availability of the Service. However, we cannot provide assurance that the Service, or any specific function or feature, will be consistently accessible and free from errors. There may be instances of unavailability during periods of scheduled upgrades or essential maintenance.

 

8. Access to the Service Outside of Singapore

The Service is accessible globally. However, we do not guarantee that the materials on the Service are suitable or accessible for use in locations beyond Singapore. Users who choose to access the Service from outside Singapore do so at their own discretion and risk, and they are responsible for adhering to all local laws and regulations.

 

9. Third Party Websites

The Service may include links to external websites and online resources. We neither assume responsibility for nor endorse such third-party sites or resources. Your utilization of external websites and resources is undertaken at your own risk.

You are permitted to establish a link to this Service under the following conditions:

a. The link is fair, legal, and does not portray any misleading association, approval, or endorsement that does not exist, or could be misleading, or could be detrimental to our reputation or that of any of our affiliates.

b. You possess the legal rights and technical capability to promptly remove the link upon our request.

 

10. Intellectual Property

The Service, including all text, images, videos, graphics, user interfaces, visual interfaces, trademarks, logos, applications, programs, computer code, and other content provided on it, is subject to intellectual property rights owned by us and our licensors. Unauthorized reproduction or copying of any such content is prohibited without our explicit prior consent.

 

11. Non-Competition

For the duration of the Service usage and 12 months following the termination of the Service usage, users agree not to directly or indirectly engage in or be associated with any business or enterprise that competes with the products/services offered by the Service within Singapore.

This non-competition clause specifically applies to the following activities:

a. Offering, providing, or being involved in the provision of insurance after-sales service modules through digital resources and software.

b. Soliciting or servicing clients, customers, or accounts that were users of the Service during the duration of Service usage.

 

12. Privacy Policy

Users consent to the collection and use of their information as outlined in the Privacy Policy.

 

13. Emergency Contact Limitation

For the duration of the Service usage, users agree not to directly or indirectly solicit or contact their clients’ Emergency Contacts other than the sole purpose of rendering insurance after-sales services for the user’s clients. We reserve the right to activate Termination referenced in clause 15 if there is a breach of this clause.  

 

14. Refund and Cancellation Policy

Once a purchase is made, it is non-refundable and non-transferable. No refunds will be issued for completed transactions.

You have the option to cancel your subscription at any time before the renewal, which takes place at 11:59 pm on the final day of your subscription. Your account will remain active until the end of your current license period. Following this, the Service will limit access to your account, retaining your client data for a maximum of 90 days from the subscription expiration date, known as the 90-Day Storage Period. Your clients will retain access to their data for a maximum of 30 days from the subscription expiration date.

After the 90-Day Storage Period, your account and all associated client data will be permanently erased. By closing your account, you acknowledge that retrieval of your information and client records will not be possible.

 

15. Termination

Users have the right to terminate their subscription at any time by following the cancellation procedures outlined in the account settings or by contacting our customer support.

We reserve the right to immediately terminate a user's access to the Service in the event of a material breach of these Terms of Usage.

Failure to make payment as per the agreed-upon terms may result in the immediate termination or suspension of the user's account.

We reserve the right to terminate accounts engaging in illegal or harmful activities on the platform without prior notice.

 

16. Limitation of Liability

The Service is provided on an "as-is" basis, and we make no representations regarding the quality, completeness, or accuracy of the content available on the Service. To the maximum extent permitted by law:

a. We expressly disclaim all conditions, warranties, and other implied terms under these Terms of Usage.

b. We disclaim any and all liability to you, whether arising under these Terms of Usage or in connection with your use of the Service.

c. The Service do not offer advice and assume no liability. All the modules in the Service, including insurance after-sales service tools, concepts, and strategies, are not intended to provide legal, tax, investment, financial, or any other advice. Any information or advice provided by you to your clients based on the Service is at your own risk, and you are fully responsible for the accuracy and completeness of any advice given.

d. The Service shall not be held liable for any misuse or improper use of the email and notification broadcast function by you, including but not limited to violations of spam regulations, fulfilling compliance checks from the insurer, accuracy and legality of the content, unauthorized dissemination of sensitive information, or any other unlawful or unethical activities conducted through the platform.

The above represents a comprehensive limitation of liability applicable to all types of damages, including compensatory, direct, indirect, or consequential damages, loss of data, income or profit, loss or damage to property, and third-party claims. However, none of the exclusions and limitations in this clause are intended to limit any rights you may have as a consumer under Singapore law or statutory rights that may not be excluded.

 

17. Duration of Terms

This agreement remains in effect until it is terminated. In the event of termination, you forfeit the right to bring claims against us or our affiliates concerning the termination.

 

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore.

Any disputes arising from these Terms shall be resolved in the courts of Singapore.
